Can I Grow Cannabis or CBD Seeds?
In the UK, it is still illegal to grow high-THC cannabis. It is classified as a Class B substance and possession can lead to arrest.
CBD is slightly different in that it is extracted from industrial hemp which has been grown in the UK for centuries (dating back to 1533, when it a law that farmers had to grow hemp on their farms). Unfortunately, in more recent times, it came to be (incorrectly) associated with cannabis strains that are high in the psychoactive cannabinoid THC. So, despite being legal, it is subject to strict regulatory oversight.
Hemp can be grown under license from the Home Office, but only the seeds and stalks can be harvested, the flowers need to be destroyed immediately and it remains illegal to grow hemp in your back garden. According to the Home Office, hemp growers are limited to using their crops for fibre and hemp seed oil production and are prevented from harvesting the flowers, extracting cannabinoids and creating CBD products. Their policy states that “licences may be issued for the cultivation of cannabis plants with a low tetrahydrocannabinol (THC) content for the production of hemp fibre for industrial purposes or the obtaining of seeds which are then pressed for their oil. For both of these uses, licences are granted to enable the use of non-controlled parts of the plant (i.e. seeds and fibre/mature stalk only). This policy is only applicable where non-controlled parts of the plant are used and does not allow for use of ‘green’ material- i.e. the leaves and flowers as these are controlled parts of the plant.”
Importantly, this means that CBD products sold in the UK are all made from hemp produced in Europe and the United States.
