We asked the team at Charlotte’s Web, and their answer was, “CBD is legal in the UK as long as it contains 0.2% of THC our products contain 0.3% THC or less as that’s what’s allowed in the US.” This means that, unless the laws change in the UK, Charlotte’s Web is not legal and won’t be available in the UK for the foreseeable future.
To triple check, we reached out to the CTA (Cannabis Trades Association) to ask for their opinion and found that Charlotte’s Web can’t be made available in the UK because it breaches the 1mg rule of the MoDR. What is the 1mg rule? This is the amount of THC per container, regardless of how large or small the container is. The ruling applies because THC (along with cannabinol) is a ‘controlled drug’ as defined under the MoDR (Misuse of Drugs Regulations). Further to this, the UK’s MDA of 1971 is clear that there is “no ‘acceptable’ level of THC in non-prescription cannabis-based products ‘off the shelf’ without prescription.”
And what about the rest of Europe? To find out more about the availability of Charlotte’s Web throughout the rest of Europe, we got in touch with Heidi’s Garden, an online store based in Zurich, who is the official EU supplier of Charlotte’s Web Hemp Products. They confirmed that they ship all Charlotte’s Web products that contain less than 0.3% THC to all countries in Europe with the exception of Sweden and the UK) and it’s legal.
It seems that, for the immediate future, CBD users in the UK aren’t going to be able to purchase Charlotte’s Web products in the near future. But if you’re living elsewhere in the EU, you can order online and have their range delivered to your door.
